Terms and Conditions

These Terms & Conditions (“Terms”) set out the agreement between JBK Outdoors (Pty) Ltd (“JBK Outdoors”, “we”, “us” or “our”) and you when you use our website, book any of our activities or events, or buy products from us. Please read them carefully. By making a booking, completing a purchase, or using our website, you confirm that you have read, understood and accepted these Terms.

1. About us and these Terms

Who we are. JBK Outdoors (Pty) Ltd is a company registered in South Africa, trading from 60 Pioneer Road, Kraaifontein, Cape Town, Western Cape, 7570. We run outdoor, fishing and camping experiences, including Catch Club events, private fishing lessons, family and group bookings, kids parties and school bookings, and we sell related outdoor products.

What these Terms cover. These Terms apply to: Catch Club events; private fishing lessons; family bookings; group bookings; kids parties; school bookings; and any products you buy from us during or alongside a booking or through our website (together, our “Services”).

Changes to these Terms. We may update these Terms from time to time, and the current version on our website will always apply to new bookings and purchases. Any booking you have already confirmed and paid for is governed by the Terms that were in place when you booked — we will not change the price, cancellation rules or other key terms of a confirmed booking without your agreement. We will show the “Last updated” date at the top so you can see when the Terms last changed.

2. A few words we use

  • Activity / Event – any experience we run, such as a Catch Club event, fishing lesson, party or school outing.
  • Booking – a reservation you make for an Activity through our online Booking Engine or directly with us.
  • Booking Engine – the online booking system on our website where you choose, reserve and pay for an Activity.
  • Participant – each person taking part in an Activity, including children.
  • Responsible Adult – the adult (18 or older) who makes the Booking and accepts these Terms on behalf of everyone on that Booking, including any children.

3. Who may book and take part

Booking. You must be at least 18 years old to make a Booking or buy products from us. When you book, you do so as the Responsible Adult and you accept these Terms on behalf of everyone included in your Booking.

Children are welcome. Children may take part in our Activities as Participants under the care of a Responsible Adult. Unless we have agreed otherwise in writing for a specific Activity, a parent, guardian or other Responsible Adult must remain present and responsible for each child throughout the Activity. JBK Outdoors does not provide general childminding or babysitting.

Accurate information. The Responsible Adult must give complete and accurate booking details, including the number and ages of Participants and any medical, dietary or special needs that could affect a Participant’s safety or enjoyment.

School and group bookings. For school bookings and similar organised groups, the school or organiser is responsible for arranging adequate adult supervision and the required supervisor-to-child ratios, and for obtaining any consents from the parents or guardians of the children attending. The person making the Booking confirms they have the authority to do so on behalf of the school or group.

4. Our activities and what to expect

Our Activities take place outdoors and often near or on water. They depend on weather, water conditions, daylight, tides, fish behaviour and other factors outside our control. For everyone’s safety, we may change, shorten, move, substitute or postpone an Activity — for example, because of weather or unsafe conditions. Where we make a significant change, we will offer you a suitable alternative, a chance to reschedule, or a refund as set out in section 7.

We focus on outdoor education, responsible fishing and care for nature. Fishing activities are run on a catch-and-release basis unless we tell you otherwise, and all Participants must follow applicable fishing rules, bag limits and permit requirements that we explain on the day.

5. Bookings and confirmation

You make Bookings through our Booking Engine or directly with us. A Booking is a request until we confirm it. A binding agreement is formed only once we have accepted your Booking and received the required payment or deposit, and you have received our booking confirmation.

We may decline or cancel a Booking before confirmation — for example, if an Activity is full, if details are incomplete or incorrect, or if we cannot safely accommodate the group. If we decline a Booking you have paid for, we will refund you in full.

Please tell us in advance about any medical condition, disability, allergy, swimming ability or other need that may affect a Participant’s safety, so we can plan appropriately or advise if an Activity is not suitable.

6. Prices and payment

All prices are in South African Rand (ZAR) and, where applicable, include Value-Added Tax (VAT). Any delivery or additional fees will be shown before you confirm and pay.

How you pay. Payment is made securely through our Booking Engine and payment partners. We currently accept Visa, Mastercard, American Express, PayPal, Payfast and Mobicred. Card and payment details are handled by our payment providers — we do not store your full card details on our systems.

Pricing errors. We take care to display prices correctly, but errors can happen. If we discover a genuine error in the price of something you have ordered, we will contact you before processing it. You may then confirm the order at the correct price or cancel it for a full refund of anything already paid.

7. Changes, cancellations and refunds (Activities)

If you need to cancel or reschedule. Please tell us as soon as possible by email or phone. Because we reserve a place, staff and resources for you, the following cancellation policy applies to Activity Bookings, based on how long before the Activity’s start time you cancel:

  • More than 48 hours before the Activity: full refund, or a free move to another available date.
  • Between 24 and 48 hours before the Activity: 50% refund, or you may move your Booking once to another available date at no extra charge.
  • Less than 24 hours before, or no-show: no refund, although we will always try to help you reschedule where we reasonably can.

Refunds are made to your original payment method and are calculated on the amount you paid for the Activity. Where you have moved a Booking, the cancellation policy then applies from the start time of the rescheduled Activity.

If we cancel or change an Activity. If we cancel an Activity, or change it so significantly that it no longer suits you (for example due to weather, unsafe conditions, or too few bookings to run it), you may choose a full refund or a free move to another date. We are not responsible for separate costs you may have incurred, such as travel.

Late arrival. Activities run to a schedule for safety and fairness to other guests. If you arrive late, we may not be able to extend your time, and missed time is not refundable.

8. Products: delivery and returns

We describe and picture our products as accurately as we can, though slight differences in colour or detail can occur on screen. Products are subject to availability, and prices may change before you order.

Delivery. Delivery is free on orders of R1 000 or more. A flat delivery fee of R150 applies to orders under R1 000. Delivery timeframes given at checkout are estimates.

Your rights if something is wrong. If a product is defective, unsafe, or not as described, you are entitled to return it for a repair, replacement or refund in line with the Consumer Protection Act. This right applies for up to six months from delivery for defects.

Change-of-mind and online cooling-off. Because you buy online, the Electronic Communications and Transactions Act gives you the right to cancel most online product orders within 7 days of delivery for a refund (you pay the cost of returning the goods). This 7-day cooling-off right does not apply to event and Activity Bookings made for a specific date, nor to products that are made to order, personalised, or that by their nature cannot be returned (for example, perishable items or bait). To start a return, contact us at info@jbkoutdoors.com. Returned products should be unused and in their original condition and packaging where possible.

9. Health, safety and conduct

To keep our Activities safe and enjoyable for everyone, all Participants and Responsible Adults agree to:

  • Follow the safety briefings and reasonable instructions of our staff at all times.
  • Wear suitable clothing and footwear, and use any safety equipment we provide (such as life jackets near water).
  • Supervise their own children, and not let Participants enter the water or handle equipment unsafely.
  • Tell our staff promptly about any injury, illness or hazard during the Activity.
  • Treat our staff, other guests, wildlife and equipment with care and respect.
  • Not take part while under the influence of alcohol or drugs that could make the Activity unsafe.

Right to refuse or remove. For the safety of others, we may refuse entry to, or remove from an Activity, anyone who behaves dangerously, abusively or unlawfully, or who ignores reasonable safety instructions. In these cases no refund is due. You are responsible for any loss or damage you or your Participants cause to our equipment through misuse.

10. Outdoor risks, your responsibility and indemnity

Please read this section carefully — it affects your legal rights.

Outdoor, water-based and fishing activities carry inherent risks that cannot be removed entirely, including slips and falls, uneven ground, weather, water, hooks and equipment, and contact with wildlife. By taking part, you confirm that you understand these risks and that you and your Participants take part voluntarily and accept the inherent risks of the Activity.

As the Responsible Adult, you agree to be responsible for the children and other Participants in your Booking, and to the fullest extent allowed by law, you indemnify JBK Outdoors against claims, loss or damage arising from your own or your Participants’ failure to follow safety instructions or these Terms.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our gross negligence or intentional wrongdoing, or for anything that may not lawfully be excluded under South African law, including the Consumer Protection Act. This section does not ask you to give up rights you cannot give up by law.

11. Photographs, media and children’s privacy

We sometimes take photographs or video at our Activities to record the day and to promote JBK Outdoors and the Catch Club, including on our website and social media.

Your choice. If you or your child appear in our photos or video, we rely on your consent to use that material. Because the law gives children special protection, we will not use identifiable images of a child for marketing without the consent of their parent or guardian. You can ask us not to photograph a Participant, or ask us to remove or stop using an image of you or your child, at any time by contacting info@jbkoutdoors.com. You can also let our staff know on the day.

12. Our liability to you

To the fullest extent allowed by law, JBK Outdoors is not liable for indirect or consequential loss (such as lost profit, travel costs or disappointment), or for loss or damage caused by events outside our reasonable control. Where we are found liable, our total liability for any Booking or order is limited to the amount you paid us for that Booking or order.

This limit does not apply to liability for death or personal injury caused by our gross negligence or intentional act, to liability for our fraud, or to any liability that may not be limited or excluded under South African law, including your rights under the Consumer Protection Act. Those rights remain unaffected by these Terms.

13. Your reviews, photos and other content

You may be able to post reviews, comments, photos or other content about JBK Outdoors, or tag us on social media. You keep ownership of what you post. By posting or tagging us, you give us permission to share and re-post that content on our own channels to promote JBK Outdoors, with credit where practical. You can ask us to stop using your content at any time.

When you post content, you confirm that it is your own (or you have permission to share it), that you have the consent of anyone identifiable in it (and the parent or guardian of any child), and that it is lawful, honest and not offensive, misleading or harmful. We may remove content that breaks these rules or that we reasonably consider inappropriate.

14. Our content

The JBK Outdoors name, logo, website, photographs, designs and other content belong to us or our licensors and are protected by law. You may view and use our website for your own personal, non-commercial use. You may not copy, reproduce, sell or commercially exploit our content or brand without our written permission.

15. Using our website responsibly

When using our website and Booking Engine, you agree not to:

  • Use the site for any unlawful or fraudulent purpose, or to impersonate someone else.
  • Interfere with, damage or attempt to gain unauthorised access to the site, its security features or other users’ accounts.
  • Introduce viruses or other harmful code, or use bots, scrapers or automated tools to harvest data from the site.
  • Copy or misuse our content, or use the site to advertise or sell competing goods or services without our permission.

If you create an account, keep your login details confidential. You are responsible for activity that takes place under your account.

16. Links to other websites

Our website may link to other websites, such as our payment providers or social media. We do not control those sites and are not responsible for their content or privacy practices. If you follow a link to another site, you do so at your own risk and subject to that site’s own terms.

17. Your privacy

We respect your privacy and handle personal information in line with the Protection of Personal Information Act (POPIA). We collect and use the information you give us to manage your Bookings, take payment, keep Participants safe, and contact you about your Booking. Please see our Privacy Policy for full details of how we collect, use and protect your information, and of your rights. Our website and information are hosted in South Africa.

18. Website availability

We aim to keep our website and Booking Engine available and accurate, but we cannot guarantee they will always be uninterrupted or error-free. We may update, suspend or withdraw parts of the site for maintenance or other reasons. We are not liable for losses caused by the website being temporarily unavailable.

19. Governing law and resolving disputes

These Terms are governed by South African law, and the courts of South Africa have jurisdiction over any dispute relating to them.

Let’s sort it out directly first. If you are unhappy with anything, please contact us at info@jbkoutdoors.com so we can try to put it right. Most issues can be resolved quickly this way.

Nothing in these Terms prevents you from exercising your rights as a consumer, including referring a complaint to the Consumer Goods and Services Ombud, the National Consumer Commission, or another body you are entitled to approach under South African law.

20. General

  • Whole agreement. These Terms, together with your booking confirmation and our Privacy Policy, make up the agreement between us.
  • If part is invalid. If any part of these Terms is found to be unenforceable, the rest of the Terms still apply.
  • No automatic waiver. If we do not enforce a term on one occasion, we may still enforce it later.
  • Events beyond our control. We are not responsible for failures or delays caused by events beyond our reasonable control, such as severe weather, natural events, power or network failures, or government action.
  • Electronic communications. You agree that we may communicate with you electronically, and that emails and online confirmations meet any legal requirement for writing.
  • Transfer. We may transfer our rights and obligations under these Terms to another business, for example if we sell or restructure JBK Outdoors. Your rights will not be affected.
